4. Order Process and Acceptance

Adding products to your cart or sending an inquiry does not by itself constitute final acceptance of your order by B-Mega Stock Europa Pallets.

A transaction is deemed accepted when one of the following occurs:

  • We issue and you accept a quotation or proforma invoice
  • We receive full or partial payment as indicated for the transaction
  • We begin preparing your order, including stock reservation, packing documentation, export paperwork, or shipment dispatch

Electronic records, emails, payment confirmations, proforma invoices, and other documentation used in the ordering process shall serve as evidence of the transaction.

5. Products and Availability

All orders are subject to stock availability. Product listings on the website do not guarantee final availability until we have accepted your order.

Product images, descriptions, categories, reference numbers, approximate unit counts, weights, measurements, conditions, classifications, and other published information are provided for informational and commercial purposes, unless expressly stated as fixed conditions of an offer.

Special Product Categories

For products sold as special offers, liquidation lots, clearance items, overstock, returns, marketplace goods, or mixed lots:

  • Contents may vary between pallets
  • Presentation or condition may depend on the specific lot
  • A lot may include items in different grades (Grade A, B, or C) without individual inspection, unless expressly stated in the offer
  • Items are sold in their current condition with the general characteristics indicated

Unless expressly stated otherwise, all lots are sold "as is" with the characteristics described in the relevant listing.

Unless explicitly stated otherwise, published prices do not include:

  • Shipping and freight costs
  • Special transport or handling fees
  • Storage charges
  • Customs duties and import taxes
  • Documentary procedures or administrative fees

All prices are shown in Euros (EUR) unless otherwise agreed in writing.

Value Added Tax (VAT)

The applicable VAT rate or tax treatment depends on the product, destination, and your tax status at the time of purchase.

For intra-EU transactions, VAT exemptions apply only if you provide a valid VAT number and the transaction meets all applicable legal requirements.

For exports outside the European Union, all taxes, duties, customs clearance, import charges, and destination costs are your responsibility unless otherwise agreed in writing.

Minimum Order

Unless stated otherwise in a specific offer, the minimum order value is €100 (excluding taxes). There is no maximum order limit, subject to stock availability and order acceptance.

7. Payment Methods

Unless another payment method is specified for your transaction, we accept:

  • Bank transfer
  • Other payment methods as agreed in writing

For orders requiring advance payment, goods will not be shipped until we have confirmed receipt of full payment, unless otherwise agreed in writing.

If a payment is rejected, reversed, incomplete, or cannot be verified, we may suspend or cancel your order.

8. Shipping and Delivery

Goods will be shipped to the address you provide. You are responsible for ensuring that delivery details, contact information, availability schedules, and receiving arrangements are correct.

Estimated Transit Times

Transit and delivery times are estimates and may vary due to volume, weight, destination, carrier schedules, peak seasons, logistics incidents, customs inspections, documentation requirements, or other circumstances beyond our control.

Typical delivery timeframes:

  • Within Europe: 7–10 business days (standard freight)
  • International/Overseas: Varies based on destination, shipping method, and customs clearance
  • Express or special shipments: As quoted for the specific transaction

Receiving Requirements

For pallet deliveries, you must have adequate staff, unloading equipment (forklift, pallet jack), machinery, and site access to receive the shipment properly.

Delivery is deemed complete when goods are made available to you or your designated representative at the specified delivery address.

9. Failed Delivery and Non-Receipt

If delivery cannot be completed due to reasons attributable to you—including absence, incorrect delivery details, lack of access, unjustified refusal, insufficient unloading equipment, or failure to collect within the agreed timeframe—we may arrange a second delivery attempt where possible.

Any costs arising from redelivery attempts, storage, immobilization, returns, document handling, customs delays, or equivalent incidents shall be borne by you where the cause is attributable to you.

If, after reasonable attempts or sufficient notice for collection, goods are not received for reasons attributable to you, we may consider your duty to accept delivery as breached and may take appropriate measures including storage, return, deposit, contract termination, or resale of goods, without obligation to reimburse costs already incurred.

10. Inspection and Transport Damage

You must inspect goods upon receipt and report any apparent issues immediately.

Visible Damage

For visible transport damage, damaged packaging, breakage, missing packages, or externally detectable delivery issues:

  • Record the issue with the carrier at time of delivery
  • Notify us in writing within 48 hours of delivery
  • Provide photographs and documentation where possible

Quantity or Quality Issues

Claims regarding apparent quantity or quality defects must be submitted in writing without delay and within legally applicable time limits.

For internal defects not apparent upon receipt, notify us in writing and provide necessary information for assessment.

Once an incident is verified, we will propose an appropriate solution, which may include replacement, substitution, partial credit, refund of affected amounts, or other commercial remedies.

11. Order Cancellation

You may request cancellation before we have begun specific order preparation, stock reservation, issuance of binding documentation, packing lists, customs handling, or shipment dispatch.

Cancellation requests must be communicated as early as possible and in any case before actual dispatch of goods.

Special Orders and Export Transactions

For special offers, liquidation lots, reserved goods, custom-prepared orders, import/export transactions, or orders where logistics processing has begun, cancellation may not be possible or may generate associated costs to be borne by you.

A cancellation request does not imply automatic acceptance. We will confirm whether cancellation is possible and communicate any applicable charges.

12. Returns and Exchanges

Important: No returns or exchanges will be accepted without our prior express written authorization.

Special Product Categories

For products or lots sold as special offers, liquidation, clearance, overstock, returns, goods sold "as is," or lots with special conditions, returns and exchanges are not accepted except in cases of:

  • Verified error in the offer or order preparation attributable to us
  • Properly documented transport damage
  • Substantial mismatch with the stated offer
  • Claims applicable under mandatory consumer protection law

Return Process

Do not send returns without prior authorization. Any unauthorized returns will not be accepted.

For international transactions, you must provide all necessary tax, customs, logistics, and documentary information required for proper order preparation and dispatch.

Transaction Finalization

The following actions constitute final acceptance of an export transaction under the communicated terms:

  • Acceptance of a proforma invoice
  • Receipt of full or partial payment
  • Sending proof of bank transfer
  • Issuance of packing lists
  • Beginning of order-specific preparation
  • Start of certificates or export documentation

Once any of these actions occur, cancellations, modifications, returns, or refunds will not be accepted for export transactions, special lots, or goods prepared for international dispatch, except in cases of error attributable to us or where required by mandatory law.

Import Responsibilities

All duties, taxes, destination charges, import costs, storage fees, delays, customs incidents, costs arising from failure to collect, border returns, or equivalent expenses are exclusively your responsibility unless otherwise agreed in writing.

If you fail to arrange or pay for international transport, or do not meet necessary requirements for dispatch or import, we may suspend the transaction, charge you for costs incurred, or require you to arrange collection by your own means within a specified timeframe.

14. Limitation of Liability

To the fullest extent permitted by law, our liability is limited as follows:

  • We are not liable for delays, failures, or losses caused by circumstances beyond our reasonable control, including force majeure events, carrier delays, customs delays, port strikes, natural disasters, or government actions
  • For liquidation lots, overstock, returns, and "as is" products, we are not liable for individual item functionality, brand authenticity claims, or precise unit counts beyond the general description provided
  • Our maximum liability for any claim shall not exceed the purchase price paid for the specific goods in question
  • We are not liable for indirect, consequential, special, or punitive damages including loss of profits, business interruption, or loss of data

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

All content on this website, including text, images, logos, product descriptions, graphics, and software, is the property of B-Mega Stock Europa Pallets or its licensors and is protected by intellectual property laws.
